Interview with Steve Bliss

Good evening, Temecula. I’m Brenda Jones reporting for Channel 7 News. Tonight, we’re talking about estate planning and the importance of protecting your assets. Joining us is renowned Temecula trust attorney, Steve Bliss from The Law Firm of Steven F. Bliss Esq. Welcome to the show, Steve.

What type of trusts do you typically recommend for your clients?

Thanks for having me, Brenda. I work with a diverse range of clients here in Temecula, so there isn’t one “size fits all” trust that I recommend. My approach always starts with understanding my client’s individual needs and goals.

However, a common choice is the Revocable Living Trust. It offers significant benefits because it allows individuals to maintain control over their assets during their lifetime while avoiding probate upon death. Consequently, this type of trust provides privacy and ensures that assets are distributed according to your wishes.

Can you elaborate on the process of setting up a Revocable Living Trust?

Certainly. Setting up a Revocable Living Trust involves several key steps. First, we identify and list all the assets you wish to include in the trust. This could encompass real estate, bank accounts, investments, and personal property.

Next, we draft the trust document, which outlines the terms of the trust, including who will manage it (the trustee) and how assets will be distributed to beneficiaries upon your passing. Moreover, I work closely with clients to ensure the trust document reflects their wishes accurately.

Are there any potential pitfalls or challenges associated with Revocable Living Trusts?

While Revocable Living Trusts are generally a sound estate planning tool, there are a few things to be mindful of. One crucial point is keeping the trust up-to-date. Life changes like marriage, divorce, or the birth of children can necessitate amendments to the trust document.

I recall one instance where a client hadn’t updated their trust after their daughter got married. This led to complications when distributing assets because her husband wasn’t included as a beneficiary. Accordingly, we had to go through probate court to resolve the issue, which was both time-consuming and costly.

It’s essential to review your trust periodically with an attorney to ensure it still aligns with your circumstances and intentions.
