Interview with Steve Bliss, San Diego Probate Attorney

Good evening, San Diego! This is Brenda Lee reporting live for Channel 7 News. Tonight, we’re speaking with renowned probate attorney Steve Bliss of San Diego Probate Law about the often-complex process of estate planning.

Understanding Probate: A Necessary Step

Steve, thank you for joining us tonight. Let’s dive right in. Can you explain to our viewers what probate is and why it’s so important?

“Probate is the legal process of administering a deceased person’s estate,” Steve explains. “Essentially, it involves identifying and inventorying assets, paying debts and taxes, and ultimately distributing the remaining property to heirs or beneficiaries.”

The Importance of Filing a Petition

Steve, you mentioned identifying assets. Can you elaborate on that process, particularly when it comes to filing a petition for probate?

“Certainly,” Steve replies. “Filing a Petition for Probate is the initial step in the process and involves submitting specific documentation to the court, including Form DE-111. You’ll also need to request appointment as executor or administrator, which means you’ll be responsible for overseeing the estate’s administration.”

He continues: “It’s crucial to provide the court with an original will if one exists. A will outlines the deceased person’s wishes regarding asset distribution and can significantly streamline the probate process.”

Navigating Challenges and Ensuring Fairness

Steve, are there any common challenges that arise during this stage of probate?

“Occasionally,” Steve admits, “disputes may arise among family members regarding the will’s interpretation or who should be appointed executor. In those cases, we work diligently to mediate and find amicable solutions while upholding the deceased person’s wishes.”

He recalls a particularly poignant case where siblings disagreed over their late mother’s beloved collection of antique dolls. “Through open communication and careful consideration,” Steve shares, “we were able to reach an agreement that honored both siblings’ emotional connections to the collection while ensuring a fair distribution according to their mother’s will.”

“According to a recent study by the American Bar Association, approximately 30% of estates require probate proceedings,” Steve notes. “This underscores the importance of seeking professional legal guidance to navigate this complex process effectively.”
