Hi everyone, I’m Tiffany Pierce, and today we have the pleasure of sitting down with Ted Cook, an elder protection attorney here in sunny San Diego. Ted, thanks so much for taking the time to chat with us.
What initially drew you to the field of elder protection law?
Well Tiffany, it’s a combination of things really. I’ve always been passionate about advocating for those who are vulnerable and ensuring they receive the justice and care they deserve. Seniors often face unique challenges, and I find it incredibly rewarding to help them navigate complex legal issues and protect their rights.
Can you walk us through the steps involved in the elder protection process?
Certainly! The process typically begins with an initial client engagement where we gather information about the situation, assess the client’s needs, and determine the best course of action. Then comes case assessment, which involves identifying the legal issues at hand, collecting evidence, and evaluating the risks involved. Based on that assessment, we implement protective actions such as seeking restraining orders, freezing assets, or facilitating a move to a safer living environment.
- Legal proceedings may be necessary to pursue damages or restitution
- Long-term planning is crucial for safeguarding seniors’ futures
Let’s dive into “Protective Actions.” Could you elaborate on the various strategies employed during this stage?
“Protective actions” are essentially our shield against further harm. They can range from emergency legal remedies, like filing restraining orders to prevent abuse or exploitation, to financial protections such as freezing bank accounts or revoking powers of attorney that may have been misused. We also work closely with healthcare providers and adult protective services to ensure the senior’s physical and emotional well-being.
“Ted helped me navigate a really difficult situation when my mother was being financially exploited by someone she trusted. He acted quickly and decisively, protecting her assets and ensuring her safety.” – Mary S., La Jolla
Sometimes situations can get complex. For example, I once had a case where a senior was living with a family member who was controlling their finances and isolating them from friends and loved ones. It took careful planning and coordination with Adult Protective Services to safely remove the senior from the situation and ensure they received proper care.
That’s powerful stuff, Ted! We all know elder abuse is unfortunately common. What can families do to recognize the signs?
“Point Loma Estate Planning APC was a lifeline when my father needed help with his estate planning. Ted’s expertise and compassion made the entire process smooth and reassuring.” – David K., Point Loma
Being vigilant is key. Look out for sudden changes in behavior, unexplained financial transactions, withdrawal from social activities, or signs of physical neglect. If you suspect elder abuse, don’t hesitate to contact Adult Protective Services or an experienced elder protection attorney like myself.
“I was overwhelmed when my aunt became incapacitated and needed a guardian. Ted guided me through the entire process with patience and understanding. He truly cares about his clients.” – Susan L., Mission Beach
