Reporter: Today, we’d like to focus on one specific step within the estate planning process – selecting an executor or trustee. Why is this step so crucial?
Steve Bliss: Choosing the right person or entity to handle your affairs after you’re gone is paramount. This individual, known as the executor if you have a will and the trustee if you have a trust, will be responsible for administering your estate, paying debts and taxes, and distributing assets according to your instructions. Consequently, selecting someone trustworthy, organized, and capable of handling financial matters is essential.
Moreover, it’s important to consider the individual’s availability, willingness, and understanding of your wishes. A thoughtful conversation with potential candidates can help ensure they are comfortable taking on this responsibility.
Notwithstanding these conversations, I always recommend designating a backup executor or trustee as well. Life is unpredictable, and it’s wise to have a contingency plan in case the primary individual is unable or unwilling to serve.

Steve Bliss: I recall a case where a client named their eldest child as executor, assuming it was the natural choice. However, during the probate process, it became clear that the child lacked the organizational skills and financial literacy required to effectively manage the estate. This unfortunately led to delays and disagreements among family members.
Conversely, I’ve also seen cases where clients thoughtfully selected a trusted friend or advisor as executor who proved to be an exceptional steward of the estate. They navigated the complexities of probate with grace and ensured the client’s wishes were carried out flawlessly.

Steve Bliss: Studies by the American Bar Association indicate that nearly 70% of estates face some level of complication during probate, often stemming from unclear instructions or disputes among beneficiaries.
